Terms of use

Last updated: October 19, 2026

1. Who these terms cover

These Website Terms of Use ("Terms") are an agreement between you and Gobeyn Enterprise LLC ("Gobeyn Enterprise," "we," "us") and govern your use of gobeynenterprise.com and its subdomains, including the client portal and the booking, contact and review features (together, the "Site").

Work for a client is governed by the signed Software and Site Development Agreement or proposal for that project, which takes priority over these Terms where they conflict.

2. Information on the Site

The Site describes our services, prices and process. Prices and timelines are starting points. A binding price or timeline is set only in a signed proposal or agreement. Nothing on the Site is a guarantee of any business result.

3. Accounts and portal access

Client portal access is by invitation only. There is no public sign-up. You must keep your credentials and authenticator app secure, must not share access, and must tell us promptly about any suspected unauthorised use. We may suspend access to protect the Site or other clients.

4. Acceptable use

You must not:

use the Site unlawfully, or to send unlawful, infringing or harmful content;

try to gain access to accounts, records, files or systems that are not yours;

scrape, copy at scale, or interfere with the Site or its security controls;

submit false information, including false reviews or enquiries;

upload files you are not entitled to share, or files containing malware.

5. Intellectual property

The Site's design, text, graphics, software and trade names belong to Gobeyn Enterprise or its licensors. You may view the Site and use it for your own business enquiries. You may not copy or exploit it beyond that without written permission.

Ownership of work we create for you is set out in the Software and Site Development Agreement and its schedules.

6. Reviews and other submissions

If you submit a review, testimonial or other content, you confirm that you have the right to do so and that it is accurate. You grant us a non-exclusive licence to publish it on the Site and in our marketing once we approve it. We may decline or remove content that is unlawful, misleading or breaches these Terms. You may ask us to remove a review you have submitted.

7. Third-party services and links

The Site uses third-party services (for example payment, scheduling, hosting and email providers) and may link to other sites. Those services and sites have their own terms and privacy practices, and we are not responsible for them.

8. Availability

We aim for reliable access but do not guarantee uninterrupted service. We may change, suspend or withdraw parts of the Site, and we may carry out maintenance.

9. Disclaimers

To the extent the law allows, the Site is provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of accuracy, fitness for a particular purpose and non-infringement.

10. Limitation of liability

To the fullest extent the law allows:

we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill arising from the Site;

our total liability for any claim arising from the Site is limited to the greater of the fees you paid us in the 12 months before the claim or one hundred U.S. dollars ($100).

Liability for services we provide to you is governed by the Software and Site Development Agreement. Nothing in these Terms limits liability that cannot lawfully be limited, including for fraud or wilful misconduct.

11. Indemnity

You will defend and reimburse us for third-party claims arising from your unlawful use of the Site or your breach of these Terms, except to the extent the claim is caused by our own unlawful conduct.

12. Governing law and disputes

These Terms are governed by the laws of the State of Michigan, without regard to conflict-of-law rules.

Please raise any dispute with us in writing first. We will try in good faith to resolve it within 30 days. If it is not resolved, the dispute will be decided exclusively by the state or federal courts located in St. Clair County, Michigan. Both parties consent to those courts.

13. Changes and severability

We may update these Terms. We will change the effective date and version. Continued use after an update means you accept it, where the law allows. If a provision is unenforceable, the rest of these Terms remains in effect. Our failure to enforce a provision is not a waiver of it.
